Terms of Service
These Terms of Service ("Terms") govern the use of the services provided by AP Interactive Solutions S.L (operating as "Hostealo"), with VAT number B56483407, registered in Spain. By creating an account, you agree to be bound by these Terms.
1. Account responsibility
You must provide truthful and complete information when creating your account. You are responsible for maintaining the confidentiality of your access credentials and for all activity carried out under your account. You must be at least 18 years old to use our services. You agree to notify us immediately of any unauthorized use of your account.
2. Services
Hostealo provides virtual private servers (VPS), dedicated servers, colocation, IP blocks, ASN registration and related hosting services. The specifications, prices and availability of the services are those described on our website at the time of contracting. We reserve the right to modify service offerings, features and prices with reasonable prior notice.
3. Payments and billing
All prices are in euros (EUR) and subject to applicable VAT under Spanish and EU tax law. Invoices are due on the date indicated. Non-payment may result in service suspension. We accept payments by bank transfer and account balance. Refunds are processed in accordance with our refund policy and applicable consumer protection law.
4. Acceptable use policy
You may not use our services for illegal activities, including but not limited to:
- Distribution of malware, phishing or spam
- Infringement of copyright or intellectual property rights
- DDoS attacks or network abuse
- Hosting of content that is illegal under Spanish or EU law
- Cryptocurrency mining without prior authorization
- Any activity that may harm our network, servers or reputation
Violation of this policy may result in immediate suspension or termination of the services without refund.
5. Service level and availability
We strive to maintain high availability for all services. Although we do not guarantee 100% uptime, we are committed to resolving incidents promptly. Scheduled maintenance will be announced in advance whenever possible. Network and hardware failures are handled with priority by our technical team.
6. Data protection and privacy
We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and Spanish data protection legislation (LOPDGDD). Your data is used exclusively for service provision, billing and communication. We do not sell or share your personal data with third parties, except where required by law or necessary for the provision of the service. You may request access to, rectification of, or deletion of your personal data at any time by contacting us.
7. Backups and data responsibility
Although we offer automated backup facilities for VPS services, you are ultimately responsible for maintaining your own backups. We are not liable for any loss of data. We recommend keeping independent backups of all critical data.
8. Suspension and termination
We may suspend or terminate the services for non-payment, breach of these Terms or violation of our Acceptable Use Policy. You may cancel services at any time through the customer panel. For active services, cancellation takes effect at the end of the current billing period. Refunds for early termination are subject to our refund policy.
9. Limitation of liability
To the maximum extent permitted by law, Hostealo shall not be liable for indirect, incidental, special, consequential or punitive damages, including lost profits, loss of data or business opportunities. Our total liability shall not exceed the amount paid by you for the specific service during the 12 months prior to the claim.
10. Changes to the terms
We reserve the right to modify these Terms at any time. Material changes will be communicated by email or through the customer panel with a minimum of 30 days' prior notice. Continued use of our services after such notice constitutes acceptance of the updated Terms.
11. Governing law
These Terms are governed by Spanish law. Any dispute shall be submitted to the jurisdiction of the courts of Malaga, Spain, without prejudice to the rights granted to you under applicable consumer protection legislation.
